These Candidate Referral Program Terms of Use (“Terms”) govern participation in the People Success Team Candidate Referral Program (“Program”). By submitting a referral, you agree to these Terms. Please read them carefully before participating.

For the purposes of these Terms:

• “Company” refers to People Success Team.
• “Partner” refers to the individual or business referring a candidate under this Program.
• “Referred Candidate” refers to the job applicant submitted by the Partner.
• “Referred Candidate Data” refers to any personal or professional information provided by the Partner about the candidate.
• “Placement” refers to a Referred Candidate being officially hired under a signed contract.
• “Referral Bonus” refers to the one-time monetary bonus earned by the Partner upon a successful Placement.

1. The Program is open to individuals and businesses referring qualified clients.
2. Partners must be at least 18 years old and legally eligible.
3. Current employees, contractors, and affiliates of People Success Team are not eligible to receive Referral Bonus.
4. No Self-Referrals – Partners cannot refer themselves or candidates they have a financial interest in.
5. No fraudulent referrals – Submitting false, misleading, or duplicate referrals will result in immediate disqualification and legal action if necessary.
6. People Success Team reserves the right to refuse any referral, at its sole discretion, for any reason.

1. Candidate Referral Form.
2. Candidate Consent Requirement: The Referred Candidate must provide explicit consent before their information is submitted.
3. Duplicate referrals will not be accepted – If multiple Partners refer the same candidate, only the first referral submitted will be considered valid.
4. A referral must not be an active candidate or already in discussions with People Success Team.
5. If a candidate is already in our database, they must not have engaged with us in the last six months to qualify as a referral.
6. A referral is valid for six (6) months from the date of submission. If a Referred Candidate is hired after six months, no reward will be paid.
7. Once approved, the Partner must send an introduction email to the referral within 180 days, or the referral will expire.
8. People Success Team has sole discretion to approve or reject referrals and is not required to provide an explanation.

1. Referral Bonuses are based on a percentage of our placement fees, subject to the following caps:
   • Associate Specialist/Sr. Specialist – 5% of our placement fees up to € 800 per candidate.
   • Business Partner/Manager/Sr. Manager – 7% of our placement fees up to € 1,500 per candidate.
   • Director & Above – 10% of our placement fees up to € 2,000 per candidate.
2. Placement Fee Calculation
   • Permanent Placement Contracts: Referral Bonus is based on the full contract fee.
   • Temporary Staffing / Subscription Contracts: Referral Bonus is based on the fee for the first 6 months.

3. Referral Bonus is gross and includes. all taxes (e.g. VAT, income, social security taxes) that are legally required.

4. Only one Referral Bonus per candidate will be paid—no ongoing commissions or multiple payments.

5. No future commissions – The Partner cannot claim additional payments beyond the one-time reward.

6. Payments are made only after:

• • The Referred Client signs a contract.
  • The Partner signs an Agreement confirming they accept the final payout. This Agreement does not create an employment or partnership relationship.

7. No rewards for canceled contracts – If the client or candidate cancels before payment, no referral bonus is issued.

8. Payments will be processed within 30 days after the client fully pays their fee. 

9. Partners are responsible for any taxes related to their reward.

10. Disputes must be raised within 30 days of payment notification. After that, the Partner has no legal claim to additional compensation.

11. People Success Team’s decision on referral approval and payment is final and binding.

1. People Success Team reserves the right to permanently ban any Partner from future participation if they engage in:
   • Fake referrals – Submitting a nonexistent or unqualified candidates.
   • Manipulating the system – Trying to claim multiple payments for the same referral.
   • No Misrepresentation – Partners may not provide false or misleading information about People Success Team or Referred Candidates.
   • Forcing or pressuring a candidate to sign a contract.
   • Violating any local, national, or international laws regarding data privacy, contracts, or financial transactions.

🚨 Any fraudulent activity will result in immediate removal from the program, forfeiture of any pending payments, and possible legal action.

1. No Legal Claims – People Success Team is not liable for any lost commissions, missed opportunities, or program changes.
2. No Guarantees – Submission of a referral does not guarantee acceptance or payment.
3. Final Decisions – All decisions made by People Success Team regarding referral approval and payment are final, non-negotiable, and legally binding.
4. No Responsibility for Partner Taxes – Partners are solely responsible for reporting and paying any applicable taxes on their rewards.
5. Program Changes & Termination – People Success Team may modify or terminate the Program at any time without notice. Any pending referrals at the time of termination will be honored if they qualify.
6. No guarantee of placement – People Success Team makes no promises that a Referred Candidate will be hired.
7. Limited Liability – People Success Team’s total liability under this agreement shall never exceed €2,000 per referral.
8. No Partner legal action – Partners cannot take legal action against People Success Team for any reason related to this Program.
9. Indemnification – Partner shall indemnify and hold harmless People Success Team and its affiliate and subsidiary companies, officers, directors, employees, licensees, successors and assigns, including those licensed or authorized by People Success Team to transmit and distribute materials, from any and all liabilities, damages, fines, judgments, claims, costs, losses, and expenses (including reasonable legal fees and costs) arising out of or related to any and all claims sustained in connection with this Terms due to the negligence, misrepresentation, failure to disclose, or intentional misconduct of Partner.

1. People Success Team and Partners agree to comply with GDPR (EU 2016/679) and other applicable data protection laws.
2. The Partner must ensure all submitted personal data is lawfully obtained.
3. The Partner must obtain explicit consent before submitting a candidate’s details.
4. People Success Team will process candidate data only for recruitment purposes.
5. The Partner acts as an independent data controller when collecting and submitting candidate information.
6. People Success Team is also an independent data controller when receiving and processing the data.
7. Data will only be retained as long as necessary.
8. Personal data will be deleted or anonymized upon request in compliance with GDPR.
9. No Spam or Unsolicited Marketing – Referrals must comply with data protection laws and anti-spam regulations.
10. Partners must maintain strict confidentiality and not disclose confidential information without written consent.

1. Partners who violate these Terms will be permanently banned and may face legal action if necessary.
2. People Success Team reserves the right to seek financial damages if a Partner:
   • Submits fraudulent referrals.
   • Attempts to bypass payment rules.
   • Engages in deceptive marketing.
   • Violates any confidentiality, data protection, or legal agreement.

🚨 If legal action is required, the Partner is responsible for all legal fees and damages.

1. The Partner’s participation begins upon acceptance into the Program and ends upon termination of their referral privileges.
2. By submitting a referral, the Partner automatically accepts these Terms, forming a legally binding contract (creating a legally binding electronic signature equivalent to a handwritten signature).
